Could you please explain in detail the term "Ordinary Rate of Pay"?
Answer: "Ordinary Rate of Pay" (ORP) means wages whether calculated by the month, the week, the day, the hour, or by piece rate; or otherwise, which an employee is entitle to receive for the normal hours of work for one day. It does not include:
(a) any payment made under an approved incentive payment scheme, or
(b) any payment for work done:
i. on a rest day, or
ii. on any gazetted public holiday granted by the employer, or
iii. on any day substituted for the gazetted public holiday.
Is there a limit on the number of hours an employee can be asked to work overtime?
Answer: There is a limit on the number of hours an employee is allowed to perform overtime. Under the Employment (Limitation of overtime Work) Regulation 1980, as amended by the Employment (Limitation of Overtime Work) (Amendment) Regulations 1991, the limit is 104 hours in any one month. Rest day O/T and public holiday O/T are not counted.
